LO-FI FIREPLACE RADIO

TERMS OF USE

Effective date: September 1, 2026. Applies to Lo-Fi Fireplace Radio on Android, Android TV, iOS, iPadOS and macOS.

The short version: the app is free, for your personal use, and comes as it is. The radio is for listening inside the app; the music belongs to the artists. Do not take the app or the station apart, and do not hammer our servers. Your consumer rights are not affected by anything below.

1. WHO WE ARE

Lo-Fi Fireplace Radio ("the app") and the radio station inside it ("the station") are made and published by Michał Daniel Dobrzański, Poland ("we", "us"). Contact: contact@lofifireplace.com.

2. THE DEAL

By installing or using the app you agree to these terms. If you do not agree, do not use the app. The room is free and needs no account; the radio offers optional purchases through your app store (section 4A). We grant you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for your own enjoyment.

3. WHAT IS OURS

The app, its artwork, animation, sounds, pixel font, name and code are ours or used under licence, and stay ours. You may not copy, modify, sell, rent, redistribute or make derivative works of the app or its assets, except where the law gives you that right regardless of this paragraph.

4. THE RADIO

  1. The station streams music by independent artists, played with their permission. Every track belongs to its artist; the app grants you the right to listen to it inside the app and nothing more.
  2. You may not record, download, extract, redistribute, re-broadcast, or use the music outside the app, and you may not use it in your own content or product.
  3. The app fetches the playlist and the music over the internet and keeps a cache on your device so the station keeps playing offline. Your carrier's data charges are yours.
  4. The station may change its tracks, its order, or go quiet, at any time and without notice. It is a courtesy, not a promise: we do not guarantee that it is available, uninterrupted, or that any given track stays on the air.

4A. LISTENER PURCHASES AND TIPS

  1. Where your build offers them, listener passes, the keys to the room and tips are sold by Google Play or the Apple App Store under that store's terms; prices are shown in the store's checkout and may change for future purchases. Refunds follow the store's policy.
  2. A subscription renews until you cancel it in your store account; cancelling keeps it until the end of the paid period. Purchases restore through the same store account.
  3. A tip is a thank-you. It buys no feature, no service and no obligation, and is not refundable except where the store's policy or the law says otherwise.
  4. Every active listener may offer a name for the supporters list. A name is reviewed by a human before it appears and may be refused or removed, at any time and without notice, if it is offensive, misleading, an advertisement or a link, or someone else's. Refusal or removal of a name is not a refund event for the purchase it came with.
  5. An approved name is shown publicly inside the app to everyone using it, on every platform, alongside the other supporters' names and their count. It stays up while the purchase it came with is active and the app opens now and then, and comes down on its own when the plan ends or the app has not opened for 90 days; the privacy policy says what is stored and for how long. Offer only a name you have the right to use, and do not offer a name to impersonate anyone.
  6. If you live in the European Union you normally have 14 days to withdraw from a purchase of digital content. Because a purchase unlocks the radio the moment it goes through, the store's checkout asks you to request that immediate start and to acknowledge that you then lose the withdrawal right once we have delivered. Nothing here takes away a refund the store's own policy gives you anyway.
  7. Your statutory guarantee comes with the purchase: under the EU rules on digital content (Directive (EU) 2019/770, as your country enacted them) what you buy has to match its description and work as it should, and where it does not you may require it to be brought into conformity, or ask for a price reduction or a refund. Sections 9 and 10 do not touch that, and neither does anything else here.

5. FAIR USE OF OUR SERVERS

The playlist endpoint and the audio host exist to serve the app. Do not access them with scripts, crawlers or anything other than the app; do not attempt to overload, probe or interfere with them; and do not try to circumvent limits we place on them. We may block traffic that does.

6. PRIVACY

What the app does with data, which is very little, is in the privacy policy: the legal basis for each part of it, how long it is kept, where it goes, and your rights under the GDPR, including the right to complain to a supervisory authority. Diagnostics are off unless you turn them on.

7. THE STORES

If you got the app from Google Play or the Apple App Store, that store's terms also apply to your download, and the store, not us, handles the distribution. Apple and Google are not responsible for the app or these terms, and have no obligation to provide support for it.

8. CHANGES

We may update the app, the station and these terms. A changed version of these terms takes effect when it is published on this page with a new effective date; keeping the app installed after that means you accept the change. If you do not, uninstall the app.

9. NO WARRANTY

The app is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent the law allows. It is an ambience app, not a safety, medical or alarm device: do not rely on it to keep you awake, put you to sleep, or wake you up.

10. LIABILITY

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, arising from your use of the app or the station. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for intent or gross negligence, or your statutory rights as a consumer.

11. LAW

These terms are governed by the law of Poland. If you live in the European Union, you also keep the protection of the mandatory consumer law of the country where you live, and you may bring a dispute before the courts there. The European Commission's online dispute resolution platform closed on 20 July 2025, so there is no longer a link to give you: if you would rather not go to court, your national consumer body or an approved alternative dispute resolution scheme will take the complaint, and the European Consumer Centre of your country will point you at the right one. Write to us first, though. It is usually faster.
